These terms are subject to modification at the time of implementation and as legal requirements and technology changes occur.

Desktop Requirements of Authorized Users:

  • Operating System:
    • Windows: 7, 8, 8.1 and 10
    • OSX: 10.8 – latest
  • Browsers: Chrome (latest), Firefox (latest), IE/Edge (latest) and Safari (latest and Mac only)
  • Third-party software providers may update browser capabilities without notice. BMD Gateway will adapt to new technical requirements as necessary.
  • Other operating system and browser combinations may work without issue, but have not been supported through testing.
  • Minimum display resolution of 1024 x 770 pixels
  • JavaScript: enabled within the browser
  • All browsers must have session cookies and SSL enabled.
  • Audio and video versions of training modules required a sound card and speakers or headphones.

Tablet/Smartphone Requirements of Authorized Users:

  • Android: 5.x (lollipop) – latest
  • iOS: 8.x – latest
  • iPad, iPad mini and iPad Pro supported
  • All browsers must have session cookies and SSL enabled.
  • Other software and browser capabilities may work without issues, but have not been supported through testing.

Authorized Administrator Requirements:

  • IE 9 and upwards
  • Safari on Mac – Latest Version
  • Chrome – Latest Version
  • Firefox – Latest Version
  • All browsers must have session cookies and SSL enabled.

Access & Tracking Requirements for All

  • Internet connection
  • Cookies must be enabled
  • Slide Mode (only text and images) – 2Mbps or faster
  • Slide + Audio mode – 3 Mbps or faster
  • Slide + Video mode – 5 Mbps or faster
  • If dormant in any training module for more than fifteen (15) minutes, training must be reloaded and can recommence at the last completed slide

Customer Support Services

Technical Support

  • Authorized Administrators (“Administrators”) will have 24-hour access to BMD Gateway’s online support portal for FAQs, and to create support cases. Technical support by phone or email will be available Monday through Friday from 8am to 7pm ET in English.

Tracking Support

  • Administrators will have ongoing monitoring access to all tracking data, including User Activity Logs and Reports, either on the System or in exported files. These reports will allow Administrators to monitor by user, course, and/or document.

Completion Reporting

  • Administrators will also have ongoing access to BMD Gateway’s completion, certification, and past due report system.

Maintenance, Upgrades and Updates

  • BMD Gateway will make commercially reasonable efforts to perform Maintenance during non-business hours. If any scheduled Maintenance will cause system or course unavailability for longer than thirty (30) minutes, BMD Gateway will provide as much advanced notice to Customer as reasonably possible.  Maintenance includes the on-going upkeep of content and tracking information on the System.
  • BMD Gateway reserves the right to make all System Upgrades that it deems commercially appropriate, will provide advanced notice to Customer of upgrades, and will provide descriptions and necessary documentation of upgrades to the Customer. To the extent practical, BMD Gateway will implement upgrades during non-business hours.  System Upgrades include changes to the functionality, interface, or features of the System.
  • BMD Gateway reserves the right to make Course Updates to any of the Training Modules created by BMD Gateway to address any features, functionality, content, changes in compliance requirements, and/or any other reason deemed appropriate by BMD Gateway. To the extent practical, BMD Gateway will implement Course Updates during non-business hours and will provide notice of said updates to the Customer.

Sexual Harassment Training Courses

  • Federal/EEOC/Statewide
    • Federal law content training including definition of sexual harassment, types of sexual harassment, preventing and reporting sexual harassment, investigation of complaints, examples of sexual harassment in real scenarios, anti-retaliation, hypotheticals and quizzes (“Federal content”).
  •  California
      • Complies with AB 1825, AB 2053 and S.B. 396, S.B 1343 in addition to Federal content.
  • Illinois
    • Complies with Illinois Human Rights Act in addition to Federal content.
    • Restaurant/Bar Employees – Complies with Illinois Human Rights Act, Ill. Comp. Stat., Chap. 775, § 2-105(B)(5) in addition to Federal content.
  • New York
    • Complies with New York State Division of Human Rights requirements in addition to Federal content.
  • New York City
    • Complies with the Stop Sexual Harassment in NYC Act in addition to New York State and Federal content; notices included
  • Connecticut
    • Complies with Connecticut Human Rights and Opportunity Act, Conn. Gen. Stat. § 46a-54(15)(B), Conn. Agencies Regs. § 46a-54-204 in addition to Federal content.
  • Delaware
    • Complies with Delaware HB 360 in addition to Federal content
  • Maine
    • Complies with Sexual Harassment Training and Education in the Workplace Law, 26 Me. Rev. Stat. §807(3) in addition to Federal content.
